HeardUp is an operational communication platform for shift-based workforces. This policy explains what information we collect from operators and their staff members, how we use it, and how we protect it.

1.Who We Are

HeardUp is a product of Comeback Gear LLC ("Company," "we," "us," or "our"), a limited liability company. HeardUp provides a workforce communication and scheduling platform that enables businesses ("Operators") to send operational messages to their shift-based teams ("Staff Members") via SMS and web-based interfaces.

This Privacy Policy applies to information collected through the HeardUp platform, including the web application available at tryheardup.com and related services.

We do not use Staff Member data for advertising, marketing to staff, or any purpose other than facilitating the operational communication requested by the Operator.

4.SMS Messaging and Communications

HeardUp sends SMS messages to Staff Members on behalf of Operators for operational purposes including:

Opt-Out: Staff Members can reply STOP to any HeardUp SMS message at any time to opt out of future messages. Upon receiving a STOP message, HeardUp will immediately suppress further SMS delivery to that number and send a confirmation message. Reply HELP for support information.

Message and data rates may apply based on the recipient's mobile carrier plan. Messaging frequency varies based on Operator usage and business needs.

Staff Members are added to the HeardUp platform by their employer (the Operator) as part of their employment relationship and shift scheduling operations. The Operator is responsible for ensuring staff are informed of and have consented to receiving operational SMS communications from HeardUp.

5.How We Share Your Information

We do not sell personal information. We share information only in the following circumstances:

Service Providers: We work with third-party vendors who help us operate the platform, including SMS delivery providers, cloud infrastructure providers, and analytics services. These providers are contractually bound to use data only as directed by us and consistent with this policy.

Operators: Staff Member engagement data (open status, acknowledgements, quiz results, gamification scores) is visible to the Operator who manages that staff member within the platform. This is core to the service.

Legal Requirements: We may disclose information if required by law, regulation, legal process, or governmental request.

Business Transfers: In the event of a merger, acquisition, or sale of assets, user information may be transferred as part of that transaction. We will notify users of any such change.

We do not share personal information with third parties for their own marketing purposes.

6.Data Retention

We retain account and operational data for as long as an Operator account is active and for a reasonable period thereafter for legal and operational purposes. Operators may request deletion of their account data by contacting us at the address below.

SMS delivery records and message logs are retained for operational reliability and compliance purposes. Staff Member records are retained for the duration of the Operator's account or until the Operator removes the staff member from their roster.

7.Security

We implement reasonable technical and organizational measures to protect personal information against unauthorized access, disclosure, alteration, or destruction. This includes encrypted data transmission (HTTPS), access controls, and secure infrastructure hosted by reputable cloud providers.

No method of transmission over the internet is 100% secure. While we work to protect your information, we cannot guarantee absolute security.

8.Your Rights and Choices

Operators may access, correct, or delete their account information and staff data through the platform dashboard or by contacting us directly.

Staff Members who wish to access, correct, or request deletion of their personal information should first contact their employer (the Operator). Staff Members may also contact us directly at the address below, and we will work with the Operator to respond to the request.

SMS Opt-Out: Reply STOP to any HeardUp message to immediately stop receiving SMS communications.

Depending on your location, you may have additional rights under applicable privacy laws. We will respond to rights requests in accordance with applicable law.

9.Children's Privacy

HeardUp is not directed to individuals under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided personal information, we will take steps to delete it promptly.

10.Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify Operators via email or a notice within the platform. Continued use of HeardUp after changes take effect constitutes acceptance of the updated policy.
